IAGLR Terms of Service

By accessing or using any of the International Association for Great Lakes Research (“IAGLR") Internet properties, including, without limitation, iaglr.org ("Website"), mobile websites, mobile applications, IAGLR profiles on social media sites and any other digital services or properties operated or used, and any others released by IAGLR from time to time (collectively referred to as the “IAGLR Sites”), you agree to comply with and be bound by these Terms of Service, the IAGLR Privacy Policy, and the IAGLR Code of Conduct (collectively, the “IAGLR User Policies”). In the IAGLR User Policies, “we”, “us,” and “our” refers to IAGLR. If you do not agree to the IAGLR User Policies, you must immediately stop using the IAGLR Sites.

1. License. The IAGLR Sites are owned by IAGLR. You are granted a personal, revocable, limited, non-exclusive, non-transferable license to access and use the IAGLR Sites conditioned on your continued acceptance and compliance with the Terms of Service. You may use the IAGLR Sites and the IAGLR Content (defined in Section 2) solely for your personal, non-commercial use. IAGLR reserves the right to bar, restrict, or suspend any user's access to the IAGLR Sites, and/or to terminate this license at any time for any reason. IAGLR reserves any rights not explicitly granted in these Terms of Service.

Unless otherwise expressly stated in these Terms of Service, or you receive IAGLR's prior written consent, you may not modify, translate, create derivative works of, copy, distribute, market, display, remove or alter any proprietary notices or labels from, lease, sell, sublicense, clone, transfer, decompile, reverse engineer, or incorporate into any information retrieval system (electronic or mechanical), the IAGLR Sites, any IAGLR Content, or any portion thereof. Further, you may not use the IAGLR Sites for any unauthorized or illegal purpose or activity or interfere with the proper working of the IAGLR Sites.

2. Proprietary Rights. The IAGLR Sites’ contents, features, and functionality, including all information, software, code, text, displays, graphics, photographs, videos, audio, design, presentation, selection, and arrangement are owned by IAGLR, our licensors, or other providers of such material and are protected in all forms by intellectual property laws, such as copyright, trademark, patent, trade secret, or any other proprietary rights.

Company names, logos, designs, images, and slogans appearing on our Sites may be trademarks of the respective company or its affiliates or licensors. You must not use such marks without the prior written permission of the owner. Any use of such marks, except as expressly authorized in writing by the owner, constitutes an infringement or violation of the rights of the owner, may be a violation of federal or other laws, and could subject the infringer to legal action.

3. Terms of Service Acceptance and Revisions. IAGLR Sites are available only to individuals who can enter into legally binding contracts under applicable law. These Terms of Service constitute a legally binding agreement between you and IAGLR regarding your use of and access to the IAGLR Sites. By using the IAGLR Sites, you agree to the Terms of Service.

IAGLR may revise the IAGLR User Policies, including the Terms of Service, at any time without prior notice by posting them on the IAGLR Website, in which case the modified Terms of Service will become effective immediately upon posting and will supersede prior versions. By using the Sites, you are agreeing to be bound by the current version of the IAGLR User Policies.

4. IAGLR User Policies; Additional Terms and Conditions. The IAGLR User Policies, as well as other additional terms and conditions applicable to certain portions of the IAGLR Sites (collectively "Additional Terms and Conditions"), are incorporated herein by this reference. One example is a “Click-Through Agreement.” In such cases, before using certain areas of the IAGLR Sites (such as the Member Portal or Conference Sites), you may be asked to indicate your acceptance of additional terms and conditions before accessing those areas. To the extent that there is a conflict between the IAGLR Terms of Service and any Additional Terms and Conditions for the activity in which you choose to participate, the Additional Terms and Conditions shall govern.

5. Personal Login Information. Certain features and areas of the IAGLR Sites are available only with registration or login. If you are required to register and select a unique login and password ("Personal Login Information"), you must keep your Personal Login Information confidential, including taking appropriate measures to maintain the confidentiality, such as logging off and closing the Internet browser, especially when you are connected to the Internet through an unsecured network or when using a public computer. Your Personal Login Information is personal to you, and you may not allow any third party to use it under any circumstances. IAGLR is not liable for any harm caused by or related to the theft, misappropriation, disclosure, or unauthorized use of your Personal Login Information. You must immediately notify us in writing if you become aware of or believe there is or may have been any unauthorized use of your Personal Login Information, or otherwise wish to deactivate your Personal Login Information due to security concerns.

6. Privacy. For information about IAGLR’s data protection practices as well as use and protection of your personal information, please read the IAGLR Privacy Policy, which is incorporated into and made a part of these Terms of Service. By using IAGLR's Sites, you consent to your information being transferred to our facilities and to the facilities of those third parties with whom we share your information as described in the IAGLR Privacy Policy.

7. Code of Conduct. IAGLR is committed to healthy, safe, and inclusive experiences for all attendees. Please read the IAGLR Code of Conduct, which is incorporated into and made a part of these Terms of Service.

8. User Obligations. You agree to abide by all applicable local, state, national, and international laws and regulations with respect to your use of the IAGLR Sites and not interfere with the use and enjoyment of the IAGLR Sites by other users or with IAGLR’s operation and management of the Sites. You agree and acknowledge that you are solely responsible for any liabilities, fines, penalties, or forfeitures occasioned by any such violations or lack of rights. You must, at all times, provide true, accurate, current, authorized, and complete information when submitting information or materials on the IAGLR Sites, including, without limitation, information required to be provided through an online IAGLR registration forms, scholarship applications, and conference session and abstract submission forms. If any false, inaccurate, untrue, unauthorized, or incomplete information is submitted by you, IAGLR reserves the right to terminate your access and use of the IAGLR Sites. You warrant that you will not impersonate any other person or entity, whether actual or fictitious, when using the IAGLR Sites, or defame or otherwise harm any party through your use of the IAGLR Sites. In addition, you agree to abide by the IAGLR Code of Conduct.

In addition, you also agree that you will not use the IAGLR Sites to:

  • Engage in unlawful purposes or in a manner prohibited by the IAGLR User Policies;
  • Knowingly send or receive, download, upload, or use any content that is not compliant with the IAGLR User Policies;
  • Send junk mail, spam, or any form of duplicative messages, whether commercial or non-commercial in nature;
  • Tamper with or breach, or attempt to tamper with or breach, the security or integrity of IAGLR’s Sites or circumvent any measures we may implement to prevent or limit any such tampering or breaching;
  • Gain or attempt to gain unauthorized access to data or content not intended for you or to user-restricted areas of our IAGLR Sites;
  • Interfere with, change, restrict, burden, disrupt, or disable our Sites or any of our systems, servers, hosts, networks, databases, software, hardware, or equipment used by or for our Website;
  • In any way reduce or encourage conduct that could reduce anyone’s use or enjoyment of our Sites, or which, as determined by us, may harm us or users of our Sites or expose anyone to liability; or
  • Introduce malicious, harmful, or disruptive code, virus, trojan horse, worm, logic bomb or other similar material, or implement denial-of-service attacks or other attacks, or otherwise interfere or attempt to interfere with the proper working of the Website.

In addition, you are solely responsible for ensuring you have all necessary rights, licences, consents, and authority for any content, material, and information you submit, post, publish, display, transmit, or otherwise communicate to our Sites (collectively, “Submissions”). You also warrant that any Submissions you make will not:

  • Violate or encourage violation of any applicable international, federal, state, provincial, or local laws, statutes, regulations, or ordinances, or contain any material that could attract civil or criminal liability under any such applicable laws, or that otherwise may conflict with these Terms of Use;
  • Infringe or misappropriate any third party’s copyright, trademark, trade secret, patent, or any other intellectual property right, or legal rights like moral rights or rights of privacy;
  • Imply endorsement by or origination from IAGLR or any other person or entity, if this is not the case;
  • Breach any obligation created by contract to which you are a party, including confidentiality obligations;
  • Breach the terms of use of any third-party website linked from our Sites; or
  • Include abusive, defamatory, discriminatory, exploitive, harassing, harmful, hateful, inflammatory, obscene, offensive, threatening, or otherwise objectionable content or material.

We may, but are not obliged to, monitor or review Submissions to our Sites, but we are not responsible for ensuring any Submission complies with these Terms of Service, nor do we review Submissions prior to such Submissions being viewable on the member portal. You are solely responsible for ensuring your Submissions comply with these Terms of Service before submitting.

9. Links to Third-Party Websites. The IAGLR Sites may provide links to other sites on the Internet that are maintained by third parties over which IAGLR exercises no control. The appearance of any such third-party links is not intended to endorse any organization, company, or product. If you decide to access any of the third-party sites linked from the IAGLR Sites, you do so entirely at your own risk. IAGLR makes no representations or warranties with respect to any linked site. On such sites, you are subject to the various terms of services associated with using such sites. For more information, consult the host website user policies.

Information (comments, photos, videos, etc.) you share with or post to IAGLR social media profiles is also subject to the terms of service of the host sites and may be used by the owners of the host sites for their own purposes under the host site user policies.

10. Links to Websites, Content, Sharing of Content. Links posted by third parties to the IAGLR Sites and/or IAGLR Content may not use the IAGLR logo and shall not suggest that IAGLR promotes or otherwise endorses any third-party products, business relationships, services, causes, campaigns, websites, content, or information. Any links to any portion of the IAGLR Sites shall be the responsibility of the linking party. IAGLR reserves the right to require any linking party to disable or remove any link that violates IAGLR's policies, rights, or causes interruption or deterioration of IAGLR Content.

Sharing of Content. You may download, copy, or embed IAGLR Content and other downloadable items displayed on the IAGLR Sites for personal use only provided that you maintain all copyright and other notices contained therein. Copying or storing of any IAGLR Content for any purpose other than personal use is expressly prohibited without prior written permission from the IAGLR. IAGLR reserves the right to require any party sharing IAGLR Content to disable or remove the content should its use violate IAGLRs policies or rights, or cause interruption or deterioration of IAGLR Content.

11. Disclaimer. IAGLR Sites are available on an “as is” and “as available” basis, without any warranties or conditions of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. You acknowledge that your use of IAGLR Sites is at your sole risk. We do not represent, warrant, covenant, or endorse that our Sites are complete, accurate, correct, secure, reliable, available, suitable, or current, or that any content, files, or data available through our Sites or otherwise will be free of viruses or other destructive code.

You acknowledge and agree that IAGLR shall not be liable to you or any other party for any loss or damage caused by a distributed denial-of-service attack, viruses, or other technologically harmful material that may affect your computer or associated computer equipment due to your use of IAGLR Sites or of any services or items obtained or downloaded by using the Sites, or any website linked to or from them. You are responsible for maintaining and implementing sufficient safeguards to satisfy your own requirements for anti-virus protection and data recovery.

12. Limitation of Liability. Under no circumstance will IAGLR nor its officers, directors, employees, independent contractors, agents, volunteers, or members be liable for any loss or damages (including direct, indirect, special, incidental, consequential, exemplary, punitive, or other damages) whatsoever, whether based in contract, tort, negligence, or any other legal theory, arising out of or in connection with your access of, use of, or inability to access or use, or reliance on the IAGLR Sites or other websites to which they link (including third-party materials). This includes, but is not limited to, content, materials, postings, or information thereon, or for any bugs, viruses, trojan horses or similar (regardless of the origin), or for any errors or omissions in any content, even if IAGLR[I1]  has been specifically advised of the possibility of such damage or loss, or if such damage or loss was foreseeable.

If you are in any way dissatisfied with the IAGLR Sites, your only remedy is to discontinue using them.

13. Waiver and Severability. A delay or failure to exercise or enforce any right or provision in these Terms of Service does not constitute a waiver of such right or provision. Nor does it limit us from taking action or exercising any rights or remedies in future. If any provision of these Terms of Service is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be enforced to the fullest extent of the law, and all other provisions shall remain in full force and effect.
